Granny Flat / Tiny Homes in Logan. Do I need Development Approval?

In short, it depends on what zone you are in and if your property is impacted by any overlays. In the majority of cases a development approval is required for a Granny Flat / Tiny Home.

So, what zones and overlays do you need to be aware of when trying to determine if your Granny Flat / Tiny Home requires a development approval? We discuss some of the most common ones below:

Low Density Residential Zone

In Logan Granny Flats / Tiny homes are defined as both Secondary Dwellings and a Dual Occupancy (Auxiliary Unit).

A Granny Flat / Tiny Home is recognised as Accepted Development (Subject to Requirements) under the Logan Planning Scheme. What this means is you need to meet all relevant required outcomes in order to avoid the requirements for a development approval. The required outcomes include such things as: setbacks, site coverage, size, car parking etc. In addition to this you will be required to meet all outcomes of any relevant overlay maps, including: flooding, vegetation removal etc. To ascertain compliance with all required outcomes, you will need to provide set of plans for assessment. In Aligns experience it is often difficult to meet all required outcomes, with a development application often triggered.

Low – Medium Density Residential Zone and Medium Density Residential Zone

The level of assessment for a Granny Flat / Tiny Home is the same as that within the Low Density Residential Zone. With a Granny Flat / Tiny Home potentially avoiding the requirement for a development application should all required outcomes be satisfied.

Rural Residential and Rural Zone

The level of assessment for a Granny Flat / Tiny Home is the same as within the Low Density Residential, Low – Medium Density Residential Zone and Medium Density Residential Zone. With a Granny Flat / Tiny Home potentially avoiding the requirement for a development application should all required outcomes be satisfied. It is worth noting that within the Rural Residential and Rural Zone its is much more common to see overlays associated with Bushfire Risk, Landslide Risk and the like. Should your property be impacted by any of these overlays the likelihood of requiring a development application will increase, with consultant reports required to address the overlays.
